The BloggingThemeStyles.com website is subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, and procedures that may be published from time to time on this Site by BloggingThemeStyles.com (collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by BloggingThemeStyles.com, acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.

3. Memberships, Payment, Renewal, and Refunds.
   • General Terms. Single Theme Purchases, Paid Memberships such as support and theme memberships are available on the Website (any such services, an “Upgrade”). By selecting a Membership or Upgrade you agree to pay BloggingThemeStyles.com the monthly or annual subscription fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly or annual subscription period as indicated. Should this website close or cease to exist, all memberships will expire at that time. Payments will be made to (‘Ramsey Khalaf‘). BloggingThemeStyles.com.com will no longer be responsible for providing support for its themes and plugins if:
     • BloggingThemeStyles.com.com is no longer actively developed as a viable product under Ramsey Khalaf (owner of BloggingThemeStyles.com).
     • BloggingThemeStyles.com.com or the parent company is purchased or bought out by another company.
     • WordPress is no longer actively developed.
   • Automatic Renewal. BloggingThemeStyles.com does not offer Automatic Renewal. If you wish to maintain an active membership, we recommend you to renew your subscription before it expires. Expiry Notices will be sent out to each member with enough time to renew.
   • Automatic Updates. Automatic updates are available to license holders who have an active and valid subscription and license key. Automatic updates are available for our themes and plugins obtained from BloggingThemeStyles.com. Automatic updates are available as long as the license key generated from the purchase is valid and active.
   • BloggingThemeStyles.com.com reserves the right to modify, change, cancel or upgrade a theme and plugin membership and/or license key without prior notice or consent (you still get the right to use your theme or membership as per the original instructions received on the day that you have purchased it). Prices of all products are subject to change without prior notice or consent.
   • Refunds. If you decide you are unhappy with the theme, we want to make things right. Please read our refund policy to find out the amount refunded and if you are eligible for a refund. If this website closes or cease to exist, payments made are not refundable unless they fall within the number of days mentioned in our refund policy, from the original transaction date, and will be honored, if requested.
4. Theme and Plugin Delivery. After we have processed your payment successfully, you will receive an email with your order number and other purchase information. Your license key is available in your account area along with your plugin downloads. You can download the theme by logging in to the account created for you when purchasing the theme and clicking on the appropriate link. Should you not receive an email containing your information, you can contact us through https://www.BloggingThemeStyles.com/contact to request your purchase information. Access to re-download purchased files will be granted so long as your license key is valid. If a license key expires, download access to the associated files will be discontinued until such time as the license key is renewed.
5. Responsibility of Website Visitors. BloggingThemeStyles.com does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. BloggingThemeStyles.com, WordPress, BloggingThemeStyles.com.com, the BloggingThemeStyles.com.com logo, and all other trademarks, service marks, content, graphics and logos used in connection with BloggingThemeStyles.com.com, or the Website are trademarks or registered trademarks of BloggingThemeStyles.com or BloggingThemeStyles.com’s licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any BloggingThemeStyles.com or third-party trademarks.
9. Marketing. BloggingThemeStyles.com reserves the right to display your comments and testimonials on the BloggingThemeStyles.com.com website and BloggingThemeStyles.com social network profiles.
10. Attribution. BloggingThemeStyles.com reserves the right to display attribution links at BloggingThemeStyles.com.com.
11. Friends of BloggingThemeStyles.com. By activating a theme or plugin from our partners, you agree to that partner’s terms of service. You can opt out of their terms of service at any time by de-activating a partner theme or plugin.
12. Changes. We are constantly updating our services, and that means sometimes we have to change the legal terms under which our services are offered. If we make changes that are material, we may (although not obligated) let you know by posting on one of our blogs or social profiles, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new Terms will take effect. If you disagree with our changes, then you should stop using BloggingThemeStyles.com.com within the designated notice period. Your continued use of BloggingThemeStyles.com.com will be subject to the new Terms. If you wish to terminate this Agreement or your BloggingThemeStyles.com.com account (if you have one), you may simply discontinue using the Website. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
14. Disclaimer of Warranties. The Website is provided “as is”. BloggingThemeStyles.com along with its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither BloggingThemeStyles.com nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
15. Limitation of Liability. In no event will BloggingThemeStyles.com, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to BloggingThemeStyles.com under this agreement during the twelve (12) month period prior to the cause of action. BloggingThemeStyles.com shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
16. General Representation and Warranty. You represent and warrant that (i) your use of the Website will be in strict accordance with the BloggingThemeStyles.com Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.
17. Indemnification. You agree to indemnify and hold harmless BloggingThemeStyles.com, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.
18. Translation. These Terms of Service were originally written in English (Canadian). We may translate these Terms into other languages. In the event of a conflict between a translated version of these Terms of Service and the English version, the English version will control.
19. Miscellaneous. This Agreement constitutes the entire agreement between BloggingThemeStyles.com and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of BloggingThemeStyles.com, or by the posting by BloggingThemeStyles.com of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of the province of British Columbia, Canada., excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in the state of Texas, USA. Except for claims for injunction or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled in accordance with Judicial Arbitration and/or Mediation Services. The arbitration shall take place in Texas, USA, in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; BloggingThemeStyles.com may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.

 

Website development

These are the terms and conditions for website development, which is provided as a custom service by Blogging Theme Styles.

After you approve the quote, the invoice sent may be for the full amount, or another agreed amount, and must be paid upon receipt.

In certain cases, we may accept 50% as an initial deposit to begin the work and the rest of the amount due on completion of the task.

You can request further work at any time. In that case, we would update the quote and send it to you for approval.

We guarantee that the customization or development works well for the current version of the CMS that you choose and plugins installed on your website. We cannot be held responsible if, after our work, a CMS update, plugin update, or a third party plugin installation breaks the functionality. However, we will be happy to help you fix the issues for the agreed rate.

Note that if you decide to use WordPress for your website and use one of our WordPress themes from Blogging Theme Styles or from our other business, Organized Themes, while one theme comes included with the price, it still comes with 1 year of updates and can be renewed by you after that 1 year, if you decide that you want the latest updates. The theme and your website will continue working forever whether you update or not. Or, consider our lifetime membership.
